AMEY LLC DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information obtained through the Services will be accurate, complete, or reliable.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AMEY LLC OR ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY SITE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMEY LLC'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE TOTAL AMOUNT YOU PAID TO AMEY LLC FOR SERVICES DIRECTLY RELATED TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not fully apply to you.
You agree to defend, indemnify, and hold harmless Amey LLC and its owners, members, managers, officers, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any information or content you submit through the Services.
Informal resolution. Before initiating formal legal proceedings, you agree to contact us at [email protected] and attempt in good faith to resolve any dispute informally for at least thirty (30) days.
Governing law. These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles that would require the application of another jurisdiction's laws.
Venue. Subject to the class action waiver below, you and Amey LLC agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction and venue of those courts.
Class action waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND AMEY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
The Services are operated from the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. You acknowledge that information you submit may be processed and stored in the United States or other countries where privacy laws may differ from those in your jurisdiction.
You may not use or access the Services if you are located in, ordinarily resident in, or subject to the laws of any jurisdiction where use of the Services would violate applicable export control, sanctions, or similar laws. You represent that you are not listed on any U.S. government restricted-party list.
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or if necessary to protect the Services, Amey LLC, or others. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
